1. Who we are
This website, proofdatum.com (the “Site”), is operated by Luenya Solutions Pte. Ltd. (UEN 202446064N), a company incorporated in Singapore with its registered office at 152 Beach Road, #23-01 Gateway East, Singapore 189721. Proofdatum is the completion assurance practice of Luenya Solutions Pte. Ltd. References to “Proofdatum”, “we”, “us” or “our” are references to Luenya Solutions Pte. Ltd. acting through its Proofdatum practice.
2. Acceptance of these Terms
By accessing or using the Site you agree to be bound by these Terms of Use (the “Terms”) and by our Privacy Policy. If you do not agree, do not use the Site. We may update the Terms from time to time. Changes take effect when posted on this page with a revised date.
3. Website content and no professional advice
The content of the Site, including insights articles and white papers, is provided for general information only. It does not constitute engineering, project assurance, legal, financial or other professional advice for any specific project or set of circumstances, and you should not rely on it as such. Professional advice is provided only under a signed engagement as described in section 4.
4. Services and engagements
Proofdatum provides independent completion assurance and related consulting services. Any engagement is subject to an agreed and signed proposal, statement of work or services agreement between Luenya Solutions Pte. Ltd. and the client. Where there is any inconsistency between these Terms and a signed engagement document, the engagement document prevails for that engagement.
5. White papers and gated content
White papers and other gated resources are provided for your personal use and for the internal business use of your organisation. You may not republish, redistribute, sell or modify them, in whole or in part, without our prior written consent. By requesting a gated resource you agree that we may send it to the email address you provide, as described in our Privacy Policy.
6. Acceptable use
You agree that you will not:
- use the Site for any unlawful purpose;
- attempt to gain unauthorised access to the Site, its hosting infrastructure or any related system;
- introduce viruses, malware or other harmful code;
- scrape, harvest or systematically extract content or data from the Site; or
- misrepresent your identity or affiliation when submitting any form on the Site.
7. Applications and other submissions
Information and documents you submit through the Site, including CVs and candidate applications, must be accurate, lawful and free of harmful code. Personal data submitted with an application is processed for recruitment and related purposes in accordance with our Privacy Policy.
8. Intellectual property
The Site and its content, including text, diagrams, graphics, logos and downloadable materials, are the property of Luenya Solutions Pte. Ltd. or its licensors and are protected by applicable intellectual property laws. CompleCore™ is a trademark of Luenya Solutions Pte. Ltd. Except as expressly permitted under these Terms, you may not reproduce, distribute or create derivative works from Site content without our prior written consent. Product names referenced on the Site are trademarks of their respective owners; no affiliation or endorsement is implied.
9. Third-party links
The Site may contain links to third-party websites. These links are provided for convenience only. We do not control and are not responsible for the content, availability or privacy practices of third-party websites.
10. Privacy and data protection
We handle personal data in accordance with our Privacy Policy and applicable data protection law, including the Singapore Personal Data Protection Act 2012.
11. Independence
Proofdatum provides independent assurance. Our advice is not tied to any software product, labour supply arrangement or delivery package, and we will disclose material actual conflicts of interest that arise in connection with an engagement.
12. Disclaimers
The Site is provided on an “as is” and “as available” basis. We use reasonable care to keep Site content accurate and current, but we give no warranty that the Site or its content is complete, accurate, up to date or uninterrupted. Nothing on the Site guarantees any project outcome, schedule result, approval or third-party decision.
13. Limitation of liability
To the maximum extent permitted by law, we exclude all liability for any loss or damage of any kind arising out of or in connection with your use of the Site or your reliance on its content, including direct, indirect, incidental and consequential loss, loss of profit, loss of revenue, loss of data and loss of opportunity. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or for any other liability that cannot be excluded or limited under Singapore law. Liability in connection with a consulting engagement is governed exclusively by the applicable engagement document.
14. Governing law and disputes
These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction.
